Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Preflite website and related services (collectively, the “Service”) provided by Preflite Inc. (“Preflite”, “we”, “us”, “our”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Changes

We may update these Terms from time to time. The “Last updated” date indicates when changes took effect. Your continued use of the Service after changes means you accept the updated Terms.

Eligibility

You must be at least 13 years old (or the age defined by your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Acceptable use

You agree not to:

  • Use the Service in violation of any applicable law.
  • Interfere with or disrupt the Service (including probing, scanning, or testing the vulnerability of any system or network).
  • Attempt to access non-public areas of the Service or other users’ data without authorization.
  • Reverse engineer, decompile, or attempt to extract source code except to the extent permitted by law.
  • Use the Service to transmit malicious code or to abuse rate limits.

Your content

You may provide inputs, data, text, or other materials to the Service (“Content”). You retain ownership of your Content.

You grant Preflite a non-exclusive, worldwide, royalty-free license to host, store, process, and display your Content solely to provide, maintain, and improve the Service.

You are responsible for your Content and represent that you have all rights necessary to provide it and to grant the license above.

Intellectual property

The Service, including all software, design, text, graphics, and trademarks (excluding your Content), is owned by Preflite and its licensors and is protected by applicable intellectual property laws.

Third-party services

The Service may integrate with or link to third-party services. We do not control those services and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their own terms.

Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREFLITE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREFLITE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold harmless Preflite and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if necessary to protect the Service. Upon termination, your right to use the Service will stop immediately.

Governing law

These Terms are governed by the laws of the jurisdiction where Preflite is organized, excluding its conflict of law rules.
